Muao Maelega was indicted on December 10, 1992 for Murder in the Second Degree in violation of Hawai'i Revised Statutes (HRS) § 707-701.5 (1993).*fn1 After a jury trial, Maelega was found guilty and convicted as charged. On December 16, 1993, the circuit court sentenced him to a term of life imprisonment with the possibility of parole. Maelega subsequently filed this timely appeal. We reverse and remand for a new trial.
